Terms of Service

1. Acceptance of Terms

By accessing or using OpenPushAPI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service. By creating an account or using any part of our platform, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms.

2. Description of Service

OpenPushAPI provides a push notification delivery platform that allows businesses to send push notifications to their users via Web Push (VAPID), Firebase Cloud Messaging (FCM), and Apple Push Notification service (APNs). The Service includes:

  • A REST API for sending and managing notifications
  • A JavaScript SDK for subscriber collection on web, and a Flutter SDK for mobile apps
  • A console dashboard for managing apps, subscribers, and campaigns
  • Analytics, segmentation, and targeting features
  • Queue-based delivery infrastructure designed to scale horizontally across worker processes

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Acceptable Use

You may not use the Service to:

  • Send spam, unsolicited notifications, or messages to users who have not explicitly opted in
  • Send notifications that violate any applicable law or regulation
  • Distribute malware, phishing links, or malicious content
  • Harass, abuse, or harm any person or group
  • Violate the intellectual property rights of others
  • Attempt to gain unauthorized access to any portion of the Service
  • Conduct automated scraping or data mining of the platform
  • Resell or redistribute the Service without written permission

Violation of these terms may result in immediate account suspension without refund.

5. Billing & Payments

Paid plans are billed monthly in advance via Stripe. By providing payment information, you authorize us to charge the applicable fees. All fees are in USD and are non-refundable except as required by law.

Overage charges: If you exceed your plan's subscriber or notification limits, overage fees may apply at the rates listed on our pricing page. Overages are billed at the end of each billing period.

Cancellation: You may cancel your subscription at any time from your billing dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are provided.

Failed payments: If a payment fails, we will retry the charge. If the payment continues to fail, your account may be downgraded to the Free plan.

6. API Usage Limits

Each plan includes limits on subscribers, monthly notifications, API calls, and other features. These limits are enforced automatically. If you exceed your plan limits, requests will be rejected with a 429 status code until your limits reset or you upgrade your plan.

We reserve the right to throttle or suspend accounts that abuse the API or generate disproportionate server load. Unlimited plan features mean unlimited within fair use policies.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.

You are responsible for obtaining valid consent from your end users before collecting their push notification subscriptions. You must provide your users with a clear opt-in mechanism and an easy way to unsubscribe.

8. Service Level

We work to maintain reliable uptime for the API and delivery infrastructure, but the Free plan is provided on a best-effort basis with no formal Service Level Agreement. Scheduled maintenance windows will be announced on our status page with at least 24 hours notice.

Plan-based SLA:

  • Free: Best-effort, no SLA
  • Starter: 99.5% monthly uptime target
  • Pro / Business: 99.9% monthly uptime target
  • Enterprise: Custom SLA negotiated in the customer agreement

SLA targets exclude scheduled maintenance, force majeure events, and outages of upstream push providers (FCM, APNs) outside our control. SLA credit terms, if applicable, are defined in your plan or contract.

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of OpenPushAPI. Our trademarks may not be used in connection with any product or service without prior written consent.

You retain ownership of all content you send through the Service. By using the Service, you grant us a limited license to process and transmit your content solely for the purpose of providing the Service.

10. Limitation of Liability

To the maximum extent permitted by law, OpenPushAPI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for any claims shall not exceed the amount paid by you to us in the 12 months preceding the claim.

11. Termination

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting support@openpushapi.com. Upon account deletion, your data will be deleted within 30 days in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or via a notice in the console. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
